Acceptance of terms
By creating an account or using Hillbagger (“the Service”, “we”, “us”, “our”) you agree to be bound by these Terms of Service. If you do not agree, you must not use the Service.
These terms apply alongside our Privacy & Cookie Policy, which explains how we handle your personal data.
Your account & minimum age
You must be at least 13 years old to use Hillbagger. If you are under 18, you must have the permission of a parent or guardian before registering.
You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You must provide accurate information when registering and keep it up to date. You may not create more than one account or share your account with another person.
If you suspect unauthorised access to your account, you must notify us immediately at legal@hillbagger.com.
Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Upload content that is false, misleading, harmful, offensive, or that infringes the intellectual property rights of another party.
- Attempt to gain unauthorised access to the Service or to other users' data.
- Scrape, crawl, or use automated tools to extract data from the Service without our express written permission.
- Interfere with or disrupt the integrity or performance of the Service.
- Impersonate another person or entity.
We reserve the right to investigate suspected violations and, where appropriate, suspend or terminate accounts without prior notice.
Your content
You retain full ownership of all content you upload or create through the Service, including GPS tracks, route plans, summit notes, and profile information (“Your Content”).
By uploading or publishing Your Content, you grant Hillbagger a non-exclusive, royalty-free, worldwide licence to store, display, and process Your Content solely to the extent necessary to operate the Service — for example, to display your routes on your public profile, calculate leaderboard rankings, and render maps. This licence does not extend to selling Your Content or sub-licensing it to third parties.
You are solely responsible for the accuracy of GPS data and route information you upload. Hillbagger does not verify the safety or accuracy of any route and accepts no liability for decisions made based on content displayed on the Service.
When you delete a route or your account, we will permanently remove Your Content from our systems in accordance with our Privacy Policy.
External services
The Service is delivered in part through the following third-party providers. Their own terms of service apply to the relevant aspects of your use of Hillbagger. We have no control over these providers' availability, pricing, or policies, and we are not liable for any disruption caused by them.
Analytics
We collect analytics data using a self-hosted, cookieless platform running on our own infrastructure in Germany. No analytics cookies are set and no data is sent to any third-party analytics service. Supporter tier
Hillbagger offers an optional paid Supporter subscription. All payments are processed by Polar. By subscribing you also agree to Polar's terms of service and billing policies.
Hillbagger does not store your payment card details, billing address, or any other payment-sensitive information. We only record whether your account currently holds an active Supporter subscription.
Subscriptions renew automatically unless cancelled before the renewal date. You can manage and cancel your subscription at any time through your account settings.
Refunds are handled by Polar as the seller of record. For subscription payments, Polar may grant a full refund if you request one within 30 daysof the date your subscription was last renewed, subject to Polar's assessment of the request. For any one-off purchases, the refund window is 10 days from the transaction date. Refund eligibility is determined by Polar in its sole discretion under Polar's Buyer Terms.
We reserve the right to modify Supporter benefits or pricing at any time. Where material changes are made, we will provide reasonable notice before they take effect for existing subscribers.
Termination
You may delete your account at any time from your account settings. Deletion permanently removes all your personal data and content from our systems. This action is irreversible.
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or if required to do so by law. Where possible, we will notify you before taking such action.
On termination, all licences granted to you under these Terms cease immediately. Sections relating to limitation of liability, governing law, and any accrued rights survive termination.
Limitation of liability & disclaimer
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components.
Hill walking and outdoor activities carry inherent risks. Routes, summit data, and navigation information on Hillbagger are provided for informational purposes only and must not be used as a substitute for appropriate safety equipment, local knowledge, or professional guidance. You undertake all outdoor activities entirely at your own risk.
To the fullest extent permitted by applicable law, Hillbagger shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. Our total aggregate liability shall not exceed the amount you paid to us in the twelve months preceding the claim, or £50 — whichever is greater.
Nothing in these Terms limits or excludes liability that cannot be excluded under applicable law, including liability for death or personal injury caused by our negligence, or for fraudulent misrepresentation.
Changes to these terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. For material changes, we will notify you by email or via an in-app notice before the changes take effect. Your continued use of the Service after changes are published constitutes acceptance of the revised Terms.
Governing law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless you are a consumer resident in another jurisdiction in which case the mandatory consumer protection laws of your country of residence may also apply.
